Order acceptance and cancellation

Please note that there are certain orders which we cannot accept and must cancel. Netherlands Star reserves the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include limitations on available quantities for purchase, inaccuracies or errors in product or pricing information, or issues identified by our fraud prevention department. We may also require additional verification or information before accepting any order. We will contact you if your order is cancelled in whole or in part, or if additional information is required to accept your order.

Both parties agree that after dispatch of the order, transport is the sole responsibility of the external logistics provider. During this phase, full ownership of the product(s) is transferred to the buyer; all associated liability and risks during transport shall be borne by the buyer.

Transfer of ownership

Ownership of the products in your order passes to you at the time the products leave our warehouse and are handed over to the carrier for shipment to an address designated by you in the order. All liabilities and risks relating to the products also pass to you at that time. By placing an order on this Site, you instruct Netherlands Star to arrange third-party shipping services on your behalf.

Price and typographical errors

While Netherlands Star strives to provide accurate product and pricing information, price or typographical errors may occur. Netherlands Star cannot confirm the price of an item until after you order it. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Netherlands Star shall have the right, at our sole discretion, to refuse or cancel orders for that item. In the event that an item is mispriced, Netherlands Star may, at our sole discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

Indemnity

You hereby indemnify Netherlands Star and undertake to keep Netherlands Star indemnified against all losses, damages, costs, liabilities, and expenses (including but not limited to legal expenses and any amounts paid by Netherlands Star to a third party in settlement of a claim or dispute on the advice of Netherlands Star's legal advisers) suffered or incurred by Netherlands Star arising out of any breach by you of any provision of these terms of service, or arising out of any claim that you have breached any provision of these terms of service.

Force majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of that party, including but not limited to any act of God, terrorism, war, political insurrection, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood, or any other natural or human-made event outside our control, which leads to the termination of an agreement or contract, nor which could reasonably have been foreseen. Any party affected by such event shall immediately notify the other party and shall use all reasonable endeavours to comply with the terms of service of this Agreement.

Termination

You agree that we may, at any time and at our sole discretion, terminate your access to the Site, with or without reason or notice to you. We shall not be liable to you or any third party for claims or damages arising out of any such termination or suspension or any other action we take in connection therewith. If applicable law requires us to give notice of termination or cancellation, we may give prior or subsequent notice by posting it on the Site or by sending a communication to any address (email or otherwise) we have for you in our records.
